1. Should suspected terrorists receive the full protections of our legal system, or should the president have more leeway to identify “enemy combatants” and prosecute them under a different set of rules?
2. Should unelected judges have the ability to overturn laws passed by the elected branches? If so, should there be any mechanism for political accountability?
3. What is the proper role for the Senate in providing “advice and consent” on the selection of federal judges? Should the Senate play the role of an equal partner to the president, or simply approve most of the president’s choices?
