Chapter 4

Chapter 4: Civil Liberties

Critical Thinking Questions

1. What is the proper balance between national security and civil liberties? Is it appropriate to restrict civil liberties during a time of war? If so, how much? And if not, why not?
2. Do you support complete freedom of speech for the most despicable group you can think of? When should speech be limited, if at all?
3. Has the Supreme Court balanced protection for the free exercise of religion without allowing the state establishment of religion, or has it swung too far in one direction? Which rulings support your conclusion?
4. Do you support due process rights for defendants in criminal cases, even if this means that some potentially guilty people go free? If so, why? If not, are you concerned about convicting innocent people?
